1. About us

These Terms of Service (“Terms”) govern your use of castiglione.shop and your purchases from the Castiglione online store. The store is operated by:

In these Terms, “we”, “us” and “our” refer to Castiglione. “You” refers to the person using the website or placing an order.

2. Acceptance of these Terms

By using our website or placing an order, you agree to these Terms, our Privacy Policy, our Shipping Policy and our Return and Refund Policy. If you do not agree, please do not use the website.

3. Eligibility

You must be at least 18 years old, or the age of majority in your place of residence, to place an order. You must provide accurate and complete information when ordering.

4. Products

We make reasonable efforts to display products accurately. Colours may vary slightly depending on your screen, and minor variations in size and finish may occur. Product images are for illustration.

Products are supplied by a third-party supplier and dispatched from China.

5. Prices and currency

Prices may be displayed and transactions may be processed in multiple currencies depending on your location, the settings available on our website and the payment method selected at checkout.

The applicable currency, product price and any delivery charges will be displayed at checkout before you place your order.

If you pay with a card issued in a different currency from the transaction currency, your card issuer or payment provider may apply a currency conversion rate and additional fees. We have no control over these charges.

Customs duties, import taxes and clearance fees charged by the destination country are your responsibility, as set out in our Shipping Policy. This does not apply to any tax we are legally required to collect at checkout.

We may correct pricing errors. If a product was listed at a clearly incorrect price, we will contact you before dispatch. You may then confirm the order at the correct price or cancel it for a full refund.

6. Orders and formation of the contract

Placing an order is an offer to buy. We will send an email acknowledging receipt of your order. This acknowledgement is not an acceptance. The contract is formed when we send you an email confirming that your order has been dispatched.

We may decline an order, for example where a product is unavailable, a pricing error has occurred or we suspect fraud. If we decline an order after payment, we refund the full amount paid to your original payment method.

7. Payment

Payment is taken at the time of order through the payment methods shown at checkout. Purchases appear on your statement as CASTIGLIONE.

8. Delivery

Processing and delivery times, split shipments and customs responsibilities are set out in our Shipping Policy, which forms part of these Terms.

9. Cancellations and refunds

Refunds and cancellations are governed by our Return and Refund Policy, which forms part of these Terms. The physical return of products is not required. If you are a consumer in the United Kingdom, the European Union or the European Economic Area, you have a statutory right of cancellation, which we extend to 30 days as described in that Policy. You may exercise it using the withdrawal function available on our website or by email.

10. Your statutory rights

Nothing in these Terms affects your statutory rights as a consumer. This includes your rights under the UK Consumer Rights Act 2015, the consumer protection laws of your EU or EEA Member State, and the mandatory consumer protection laws of the United States, Canada or Mexico, as applicable.

11. Use of the website

You agree not to:

use the website for any unlawful purpose;
attempt to gain unauthorised access to our systems;
interfere with the operation of the website;
use automated means to extract content without our written permission;
submit false or fraudulent orders or refund requests.

12. Intellectual property

All content on the website, including text, images, graphics, logos and the Castiglione name, belongs to Castiglione or its licensors. It is protected by intellectual property laws. You may not reproduce, distribute or use this content for commercial purposes without our prior written consent.

13. Third-party links and services

The website may contain links to third-party websites or services. We are not responsible for their content or practices.

14. Limitation of liability

Nothing in these Terms excludes or limits our liability for:

death or personal injury caused by our negligence;
fraud or fraudulent misrepresentation;
breach of your statutory rights as a consumer;
any other liability that cannot be excluded or limited by law.

Subject to the above, we are not liable for losses that were not reasonably foreseeable when the contract was formed, or for losses relating to any business use of the products, such as loss of profit, loss of business or business interruption.

Subject to the above, our total liability to you in connection with an order is limited to the amount you paid for that order.

15. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, strikes, pandemics, customs inspections, carrier disruptions and government actions. If such an event affects your order, we will inform you. Your rights under our Return and Refund Policy remain available.

16. Privacy

We process your personal data as described in our Privacy Policy.

17. Governing law and jurisdiction

These Terms and any contract between us are governed by applicable law, without depriving consumers of the protection of mandatory provisions of the law of their country of residence.

Consumers may bring proceedings before the competent courts available to them under applicable consumer protection law.

18. Resolving complaints

Please contact support@castiglione.shop first so that we can try to resolve any issue. This does not limit your right to go to court or to use any dispute resolution procedure available to you under the law of your country of residence.

19. Changes to these Terms

We may update these Terms. The version in force when you place your order applies to that order.

20. Severability and entire agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with the policies referred to in them, form the entire agreement between you and us regarding your purchase.
